U.S. Supreme Court Holds The Fate Of 4 Million In Its Hands


President Obama’s plan to offer temporary “safe” status to approximately 4 million illegal immigrants may be in jeopardy.  His plan, which was temporarily put on hold by a lower court, applies only to those who are parents of American citizens and who arrived illegally in the U.S. before 2010.

Mr. Obama’s plan did not sit well with 26 Republican-led states, headed by Texas, who have brought the case to the Supreme Court of the United States (SCOTUS), claiming that they have a say in the matter because the law would require them to issue the illegal immigrants driver’s licenses, and that that would harm the state’s interests.  It is at the Supreme Court because the argument raises a Constitutional question:  whether a president can make changes in law without congressional approval.

Getting down to a technical question, the SCOTUS heard arguments on whether Texas even had the right to challenge the law, which in legal jargon is called “standing”.  The Obama Administration contends that Texas does not have standing since it hasn’t been harmed by the law.  However, Texas argues that it would be hurt because it has to issue driver’s licenses on behalf of the people who are affected by the law.

Ultimately, the Court’s decision could do more than settle the issue at hand.  It could potentially redefine the balance of power between Congress and the president.
